The Michigan Supreme Court issued a unanimous opinion upholding the Appeals Court ruling that the 3% employee withholding to MPSERS that was a part of Public Act 75 of 2010, was unconstitutional. As a result the amount that was withheld from employees while this Act was in effect will be refunded. ORS has not issued guidance yet, we expect some guidance to be released after the new year. It is highly likely that individual districts, as the employer, will be issuing the refunds and that this payment will be taxable to the employee in the calendar year when the checks are issued . What is not yet known is:
- who will make interest payments to the employees and issue related 1099’s.
- how ORS will provide funds to local districts to make these payments
Wayne RESA will continue to monitor developments in regard to this issue and will provide technical assistance as that information becomes available.
